Executive production
The legal nature of executive production is a compulsory method of performance of judicial acts of courts of law and arbitration courts, and also certificates of other bodies, which have the right impose on the debtor the responsibility on transfer to prospectot money resources either other property, or fulfilment in their advantage of certain actions or abstention from fulfilment of these actions. Direct realisation of functions of performance of certificates is assigned to judicial police officers-executors who are civil servants. Requests of the court usher – the executor on performance of judicial certificates and certificates of other bodies are obligatory for all bodies, organisations, officials and citizens on all territory of the Russian Federation.
The performance purpose is the complete satisfaction of requests of prospector, indicated in the executive document, with observance of all legitimate rights of the persons participating in executive production.
The parties at the process of executive actions have the right to get acquainted with executive production materials, to make statements of them, to make copies, to represent additional materials, to participate in fulfilment of executive actions, to appeal against action (inactivity) of the court usher - the executor etc.
From the moment of start of executive production between parties and the court usher the imperiously-subordinated relations arise. For not fulfilment by citizens and officials of legal requirements of the judicial police officer-executor fines are applied.
