Family disputes
All family relations can be divided into 4 groups:
- Personal relations and privity between spouses, i.e. marital relationships covering not only questions of the entrance into the marriage, its terminations and annulment, but also questions of personal rights and responsibilities of spouses; questions of a lawful and contractual type of property of spouses and their obligations;
- Personal relations and privity between parents and children (or the persons equal to them - p.e., adoptive parents and adopted children), including similar relations like other relatives and other persons in the cases and limits established by the family legislation;
- Personal relations and privity connected with the settlement in a family of children left without parental support, including relations connected with adoption, guardianship, education of children in a foster family and other forms of upbringing;
- Alimentary relations, which are able to arise not only between parents and children, spouses and ex-spouses, but also between other persons recognised by the family legislation in similar cases as members of the family (relatives under the ascending and descending line of consanguinity, pupils and actual tutors and so on);
Article 8 of the Family code of the Russian Federation gives a general characteristic of jurisdictional form of protection of family laws, i.e. activity of strangers in relation to contestant parties, which have authorities on protection of the violated rights and legitimate interests. The indicated form of protection of the rights includes judicial and administrative ways of dealing with the issue.
